OVERVIEW —  For the Grand Prize, a Pair of Tickets for every Fox Presents! show/concert within the season:

  • The Fox stages between 20 – 35 Fox Presents! Shows/concerts each year. As it is unknown how many Fox Presents! shows/concerts will be booked in the upcoming year, there will be a minimum guarantee of 20 shows/concerts for the winner to attend. However, regardless of the minimum, the winner will receive tickets to each Fox Presents! show/concert booked through Feb 28, 2021.
  • Winning seats will be the best available seats in the front orchestra
  • Tickets will be made available prior to each show at The Fox Tucson Theatre Box Office under the winner’s name. Advanced arrangements may be made through the Fox Box Office to have tickets mailed to the winner prior to each show.
  • Tickets are transferable, but arrangements must be made within 5 business days with the Fox Box Office to transfer tickets to another party.
  • Tickets will be mailed to the winner, or can be picked up at will-call. These arrangements can be made with the Fox Box Office.
  • A Maximum of 1,500 tickets will be sold and the winner will be drawn at the Fox Tucson Theatre before showtime on February 27, 2020. The winner need not be present. The purchase of raffle tickets is not tax deductible as a charitable contribution, but the income does benefit the Fox Tucson Theatre Foundation.


ELIGIBILITY: Entry purchaser, and anyone to whom an entry purchaser legally transfers an entry, must be either a business entity or an individual 21 years or older at time of entry purchase. Individuals buying on behalf of a business/legal entity must be legal representatives of the business and must, themselves, be 21 years or older at the time of entry purchase. Initial entry purchaser must be present in the state of Arizona at the time of entry purchase. Arizona residency is not required for purchase. Only one (1) individual may be identified as an entry purchaser. All federal, state and local laws and regulations apply. Entries may be purchased via the internet or the box office. By entering the Raffle, the entry purchaser acknowledges that he or she is aware of, and agrees to abide by, the Raffle’s rules and regulations. The following individuals and their respective affiliates, subsidiaries, parent and related companies and agencies are not eligible to win a prize in the Raffle: (a) Executive management and staff of the Fox Tucson Theatre Foundation. The above list of exclusions also applies to immediate family members residing in the same household.

RAFFLE DRAWINGS: Only 1,500 tickets will be sold at two price points with limited quantities of each: single tickets for $25 and 5-packs for $100. Draw date is February 27, 2020, for which entries will be accepted until 7:00pm on February 27, 2020. The Second Place Prize will be drawn first, then progressing next to the Grand Prize. After each draw, the winner’s entry number will be returned for all subsequent draws. Each entry remains in the draw for all prize drawings. All entries are non-refundable after the 7:00pm 2/27 deadline or once an entry has been included in any draw.

PRIZES: The odds of a single ticket winning a prize vary depending on the number of tickets sold. The approximate retail value of the main prize is $3000 based on an estimation that there will be a minimum of twenty Fox Presents! shows/concerts held throughout 2020 (from drawing date of 2/27/2020 through 2/28/2021). Value is based on the average ticket prices for Front Orchestra pricing. It should be noted that ticket pricing varies greatly per show/concert. Prizes may not be exchanged for cash value. With proper transfer notification through the Box Office, the full prize or individual show/concert tickets may be transferred but not sold. Prizes or tickets to individual shows may also be donated back to the Fox Tucson Theatre Foundation.

NOTIFICATION OF WINNERS: All winners will be notified via email or telephone by the Fox Tucson Theatre Foundation’s representative. A recognized state of Arizona form of identification is required to claim the prize. All winners must claim their prize within fourteen (14) calendar days of the drawing. All  winners shall be responsible for any and all state or local taxes. Two (2) business days after the completion of the drawing, a complete prize winners list with winners’ names will be available on the website at foxtucson.com/event/raffle. Using the information provided, if a selected winner is unable to be contacted or located prior to the deadline for claiming the prize, the prize or a cash equivalent will revert to the Fox Tucson Theatre Foundation. In the event a winning entry has more than one name listed (or is a “joint group purchase”, the Administrator will physically award the prize to the first name listed on the entry. For tax purposes, the prize can’t be split among all verified prize winners. Fox Tucson Theatre Foundation nor their legal counsel are responsible for resolving disputes which may arise from any conflict between or among joint ticket holders or purchasers.

PRIVACY:  By entering the Raffle, entry purchasers agree that their information provided in connection with the Raffle entry may be used for communications promoting the Raffle and future raffles sponsored by or conducted for the benefit of the Fox Tucson Theatre Foundation. An entry purchaser may subsequently “opt-out” of the receipt of Raffle communications by following the directions in any email, other communication or by contacting the Administrator.  Other than as provided herein, or as required by law or court order, an entry purchaser’s information will not be shared with or sold to any other person or entity.  Purchase of an entry in the Raffle constitutes permission for the Raffle and the Fox Tucson Theatre Foundation to use winner’s name, address and/or likeness, in perpetuity, for purposes of advertising the Raffle or future raffles without further consent or compensation, unless prohibited by law.

REQUIREMENTS:  Potential winners must complete all steps outlined in their winners’ letter within the designated time frame.  If an entrant is found to be ineligible, or if a potential winner does not comply with the Official Rules, then the potential winner will be disqualified and the prize may be re-awarded through another drawing or will revert to the Fox Tucson Theatre Foundation.

RAFFLE CANCELLATION:  In the unforeseen event the Raffle is cancelled or cannot be completed, every effort will be made to refund the ticket purchase price to all Raffle ticket purchasers. The Fox Tucson Theatre Foundation’s combined liability to any ticket purchaser is limited to the purchase price of the ticket.

WAVIER / LIMITATIONS OF LIABILITY:  Except as described in the previous paragraph, entry purchasers, by participating (and winners, by accepting a prize), release the Fox Tucson Theatre Foundation and their respective parent companies affiliates, partners, subsidiaries, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising and promotion agencies, from any and all liability with respect to participation in the promotion, possession, use and distribution of the prize(s) awarded.

INTERNET:  The Raffle will pursue all available legal remedies against any individual(s) damaging or attempting to damage Fox Tucson Theatre Foundation’s website or attempting to undermine the lawful operation of the Raffle.

ARBITRATION: In the event a dispute shall arise between the purchaser and the Fox Tucson Theatre Foundation any controversy or claim arising out of or relating to the raffle, shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.  The place of arbitration shall be in the State of Arizona.  Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

FORCE MAJEURE: The Fox Tucson Theatre Foundation shall not be liable for any delay in or failure of its performance of the raffle if such delay or failure arises by any reason beyond reasonable control, including any act of God, any acts of the common enemy, the elements, earthquakes, floods, fires, epidemics, riots, failures or delay in transportation or communications, or any act or failure to act by the other party or such other party’s employees, agents or contractors. In the event that an individual concert is cancelled for any reason during the season, the winner of the Fox Presents! ticket package will not be granted additional show/concert opportunities as a replacement. However, it is guaranteed that the ticket winner will get the opportunity to attend at least 20 shows from 2/27/2020 – 2/28/2021.

GOVERNING LAW:  Should a dispute arise between a purchaser and the Fox Tucson Theatre Foundation, purchaser agrees that all cases, controversies, and legal issues shall be governed by the laws and jurisdiction of the State of Arizona.

TAXES AND IRS RULES:  All winners shall be responsible for any and all federal state and local income or excise taxes, fees, assessments and like charges associated with the prizes.

SPECIAL NOTE:  At the time of this raffle, federal law requires that corresponding tax withholding on prize values of $5,000 or greater must be collected from winners upon award and distribution.  There is a  possibility that the Grand Prize of a pair of tickets to every Fox Presents! show/concert will have an ending value of $5000 or more. In the event of this happening, the Fox Tucson Theatre Foundation will send the Grand Prize Winner notice of the final prize value. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time prizes are claimed will be followed.  The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution.
